Terms of Use for Audio Companion: Hearing Tools

Introduction

These Terms of Use ("Terms") govern your access to and use of Audio Companion: Hearing Tools ("App"), provided by Halmob ("we," "our," or "us").

By downloading, installing, purchasing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be legally able to enter into these Terms. If you are under the age of majority where you live, you may use the App only with permission and supervision from a parent or legal guardian who accepts these Terms on your behalf.

2. Service Description

The App is an iOS listening and accessibility utility that may provide:

• Microphone-based live listening through compatible audio outputs.
• Audio-processing controls intended to make nearby sounds easier to hear.
• Optional speech recognition and live or saved transcripts.
• Local audio recording, playback, transcript, export, and deletion tools.
• Read-only headphone audio exposure information from Apple HealthKit where supported and authorized.

Features may vary by device, iOS version, language, region, hardware, permission settings, and subscription status. We may add, change, suspend, or remove features at any time.

3. License to Use

Subject to your compliance with these Terms, Halmob grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on Apple devices that you own or control for personal, non-commercial purposes.

You may not:

• Copy, modify, translate, or create derivative works of the App.
• Reverse engineer, decompile, disassemble, or attempt to obtain the App's source code, except where applicable law expressly permits it.
• Rent, lease, lend, sell, sublicense, redistribute, or transfer the App.
• Remove or alter copyright, trademark, or other proprietary notices.
• Circumvent subscriptions, security controls, usage limits, or access restrictions.
• Use the App for an illegal, harmful, deceptive, or unauthorized purpose.

4. Subscriptions and In-App Purchases

The App may offer access to premium features through auto-renewing subscriptions managed through Apple's App Store and Adapty.

• Prices, billing periods, trial terms, and included features are displayed before purchase and may vary by country, currency, and tax requirements.
• Payment is charged to your Apple ID account when you confirm the purchase.
• A subscription renews automatically unless you turn off auto-renew at least 24 hours before the current period ends. Apple may charge the renewal price within 24 hours before that period ends.
• You can manage or cancel subscriptions in iOS Settings > [your name] > Subscriptions. Cancellation takes effect at the end of the current billing period; subscription features remain available until then.
• If a free trial is offered, it may convert to a paid subscription unless canceled before it ends. Any unused portion of a trial may be forfeited when you purchase a subscription.
• Purchases are tied to your Apple ID and may be restored using the App's restore-purchases feature.

Apple handles billing, cancellations, and refunds under its policies. Refund requests may be submitted at reportaproblem.apple.com. Except where required by law, Halmob does not issue App Store refunds directly.

5. End User License Agreement (EULA)

Your use of the App is also subject to Apple's End User License Agreement (EULA) ("Apple EULA"). If these Terms conflict with mandatory provisions of the Apple EULA, those provisions control.

These Terms are between you and Halmob, not Apple. Halmob, not Apple, is responsible for the App, maintenance, support, and addressing claims relating to the App, subject to these Terms and applicable law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

6. Important Medical and Hearing Disclaimer

THE APP IS NOT A MEDICAL DEVICE, HEARING AID, HEARING TEST, OR EMERGENCY-ASSISTANCE SERVICE. IT DOES NOT DIAGNOSE, MONITOR, TREAT, CURE, OR PREVENT HEARING LOSS, TINNITUS, OR ANY OTHER MEDICAL CONDITION, AND IT IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE OR CARE.

• Do not rely on the App to make medical, health, workplace-safety, or emergency decisions.
• If you have sudden hearing loss, ear pain, dizziness, persistent ringing, or another health concern, stop using the App and seek advice from a qualified healthcare professional.
• The App does not replace prescribed hearing aids, assistive equipment, hearing protection, alarms, or emergency-alert systems.
• Headphone audio exposure information is historical or informational data provided through Apple Health and may be incomplete, delayed, unavailable, or inaccurate.

7. Listening Safety

You are responsible for selecting a safe listening volume and using compatible equipment. Amplified sound and prolonged headphone use may cause discomfort or hearing damage.

• Begin at a low volume, increase it gradually, and stop using the App if you experience pain, ringing, pressure, dizziness, or discomfort.
• Do not use the App in a way that prevents you from hearing alarms, traffic, instructions, or other important environmental sounds.
• Do not adjust or closely watch the App while driving, cycling, operating machinery, crossing roads, or performing another activity that requires full attention.
• Follow applicable workplace rules and use certified hearing protection in hazardous or high-noise environments. The App is not hearing protection.

8. Microphone, Recording, and Transcription Responsibilities

You control when the microphone, recording, and transcription features are used. You are solely responsible for your use of those features and for all audio and text you create.

• Obtain all notices, permissions, and consents required before recording or transcribing another person.
• Comply with wiretapping, eavesdropping, privacy, employment, education, confidentiality, and intellectual-property laws that apply where you use the App.
• Do not use the App for covert, unlawful, harassing, discriminatory, infringing, or harmful surveillance or recording.
• Do not record confidential, privileged, or sensitive information unless you are authorized and can protect it appropriately.
• Review transcripts before relying on or sharing them. Speech recognition may omit, mishear, or incorrectly transcribe words, names, numbers, speakers, and context.

9. Health Data

If you authorize HealthKit access, the App may read available headphone audio exposure information for display within the App. The App does not write to or alter your Health records. You must not treat displayed Health data as a diagnosis, personalized medical recommendation, or guarantee of safe exposure. You can revoke the App's Health access through iOS or Health settings.

10. User Content and Local Storage

You retain ownership of recordings, transcripts, and other content you create with the App ("User Content"). Halmob does not claim ownership of your User Content.

• User Content is stored locally on your device unless you choose to export or share it or your Apple backup settings include it in a device backup.
• You are responsible for reviewing, securing, backing up, exporting, deleting, and lawfully sharing your User Content.
• Halmob does not operate a cloud backup or recovery service for recordings or transcripts and cannot restore deleted local content.
• You represent that you have all rights and permissions needed to create, keep, use, and share your User Content.

11. Third-Party Services

The App may depend on Apple technologies and Adapty for speech recognition, HealthKit access, payments, subscriptions, and entitlement management. Third-party services may be unavailable, interrupted, changed, or discontinued and are governed by their own terms and privacy policies. Halmob is not responsible for third-party services beyond what applicable law requires.

12. Privacy

Our Privacy Policy explains how information is handled when you use the App and forms part of these Terms.

13. Intellectual Property

The App, including its software, interface, design, text, graphics, branding, and other content provided by Halmob, is owned by Halmob or its licensors and protected by intellectual-property laws. Except for the limited license in these Terms, no right, title, or interest in the App is transferred to you.

Apple, App Store, HealthKit, iOS, and related marks are trademarks of Apple Inc. Adapty and related marks belong to their respective owner.

14. Availability, Compatibility, and Updates

• App performance depends on your device, microphone, headphones or other audio output, battery, iOS version, language, permissions, connectivity, and Apple services.
• Audio quality, latency, feedback, speech-recognition accuracy, and Health data availability are not guaranteed.
• Speech recognition, purchase restoration, and subscription verification may require an internet connection. Your carrier may charge for data use.
• We may provide updates that are required for continued use. We do not guarantee support for every device or iOS version.
• We may modify, suspend, or discontinue the App or any feature, subject to applicable law.

15. Termination

You may stop using the App at any time and may terminate your license by deleting it. Canceling a subscription and deleting the App are separate actions; deleting the App does not automatically cancel an active subscription.

We may suspend or terminate your right to use the App if you materially violate these Terms. When the license ends, you must stop using and delete the App. Local App data may be deleted when you uninstall the App, while exported copies and Apple-managed backups may remain. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, liability limits, and governing law.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, QUIET ENJOYMENT, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, medically suitable, compatible with every device or accessory, or that live listening, recordings, transcripts, speech recognition, subscription access, or Health information will be complete, timely, or accurate.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HALMOB AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, HEARING, HEALTH, OR USE, ARISING FROM OR RELATED TO THE APP OR THESE TERMS.

This limitation includes claims related to excessive volume, missed environmental sounds or alerts, inaccurate or unavailable transcription, incomplete or delayed Health information, recording or consent violations, data loss, device or accessory incompatibility, and interrupted service.

To the maximum extent permitted by law, Halmob's total liability for any claim related to the App or these Terms will not exceed the amount you paid for the App in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded or limits mandatory consumer rights.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold Halmob harmless from claims, losses, liabilities, damages, and reasonable expenses arising from your misuse of the App, unlawful recording or sharing, violation of these Terms, or infringement of another person's rights.

19. Governing Law

These Terms are governed by the laws of Turkey, without regard to conflict-of-law provisions. Courts in Istanbul, Turkey will have jurisdiction unless mandatory consumer-protection law in your place of residence requires otherwise.

20. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page, update the "Last Updated" date, and provide additional notice where required. Your continued use of the App after revised Terms take effect means you accept them.

21. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, the Privacy Policy, and the applicable Apple EULA form the entire agreement between you and Halmob regarding the App and replace prior agreements about its use.
