Welcome to Vibe Widget. These Terms and Conditions ("Terms") govern your use of the Vibe Widget mobile application (the "App") operated by Halmob ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations

2. Description of Service

Vibe Widget is an AI-powered iOS widget generator that:

• Creates Home Screen widgets from natural language prompts
• Uses artificial intelligence (Google Gemini) to interpret your descriptions
• Renders widgets using native iOS technologies
• Allows deployment of widgets to your Home Screen

3. User Accounts

3.1 Account Creation

You may be required to create an account to access certain features. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse the service or other users

4. Subscriptions and Payments

4.1 Premium Features

The App offers premium features through in-app purchases and subscriptions managed by RevenueCat.

4.2 Billing

• Subscriptions are billed through your Apple ID account
• Payment is charged at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Prices are subject to change with notice

4.3 Cancellation

• You can manage and cancel subscriptions in your Apple ID account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods

4.4 Refunds

Refund requests are handled by Apple according to their App Store policies. Contact Apple Support for refund inquiries.

5. Acceptable Use

You agree NOT to use the App to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App or servers
• Reverse engineer, decompile, or disassemble the App
• Use automated systems or bots to access the App
• Circumvent any usage limits or restrictions

6. AI-Generated Content

6.1 Nature of AI Content

Widgets are generated using Google Gemini AI. You understand that:

• AI-generated content may not always be accurate or appropriate
• Results may vary based on your prompts
• We do not guarantee specific outcomes

6.2 Your Prompts

• You retain ownership of the prompts you create
• You grant us a license to process your prompts through AI services
• You are responsible for the content of your prompts

6.3 Generated Widgets

• You may use generated widgets for personal purposes
• Commercial use may be subject to additional terms
• We reserve the right to use anonymized data to improve our services

7. Intellectual Property

7.1 Our Property

The App, including its design, code, features, and content, is owned by Halmob and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App.

7.2 Restrictions

You may not:

• Copy, modify, or distribute the App
• Create derivative works based on the App
• Use our trademarks without permission
• Remove any proprietary notices from the App

8. Third-Party Services

The App integrates with third-party services:

• Firebase (Google): Analytics and crash reporting
• Mixpanel: Usage analytics
• RevenueCat: Subscription management
• Google Gemini: AI widget generation
• Apple Services: App Store, WidgetKit, notifications

Your use of these services is subject to their respective terms and privacy policies.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF AI-GENERATED CONTENT

We do not warrant that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• Results will meet your requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HALMOB SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Any damages arising from your use or inability to use the App
• Any content or conduct of third parties

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Halmob, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you generate or submit

12. Modifications to Service

We reserve the right to:

• Modify or discontinue the App at any time
• Change features, functionality, or pricing
• Limit usage or access to certain features

We will provide reasonable notice of material changes when possible.

13. Changes to Terms

We may update these Terms at any time. Changes are effective when posted. Your continued use of the App after changes constitutes acceptance. We encourage you to review these Terms periodically.

14. Governing Law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Istanbul, Türkiye.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any claim, you agree to contact us at [email protected] to attempt informal resolution.

15.2 Arbitration

Any disputes not resolved informally may be subject to binding arbitration, except for claims that may be brought in small claims court.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Halmob regarding the App.

18. Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

19. Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.
